Man charged for felony DUI after fatal crash

A 52-year-old man in South Carolina is facing felony DUI charges as a result of a fatal car crash that happened in Seneca on Sept. 6. The crash involved five cars and a total of seven people. A married couple was killed in the accident, and four other people were injured.

On Sept. 8, the man accused of causing the accident was charged for two counts of felony DUI causing death. The man was also served a bench warrant for a prior case. His bail was set at $50,000 for each of his most recent felony charges. By the following day, the accused man was reportedly still being held at Oconee County Detention Center.

The Oconee County Coroner's Office reported that the incident in question took place along Sandifer Boulevard at about 7:45 p.m. A couple traveling in a 1995 Mazda sedan were killed after being broadsided by a pickup truck. The 29-year-old man died at the scene and his 28-year-old wife died later at Oconee Medical Center. Three other vehicles were somehow involved in the wreck, and one man was taken to Greenville Memorial Hospital by helicopter. Three other women were treated and released from Oconee Medical Center.

A person accused of causing a fatal car crash may be able to receive reduced charges by arguing that they were not intoxicated before the accident occurred. This outcome may be achieved by disputing the legitimacy of some of the evidence that might be presented by the prosecution. If police testimony about a field sobriety test is presented, for instance, a criminal defense attorney may argue that the test is unscientific and an inaccurate measurement of a driver's intoxication level.
